Cosmo Pop · Legal
Terms of Service
Version 2 - last updated May 19, 2026
By installing, opening, or using Cosmo Pop (the "Game") you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Game.
1. Eligibility
You must be at least 13 years old (or the digital-consent age required by your country) to use the Game. If you are under 18, you must have your parent or legal guardian's permission to make any in-app purchase. The developer may refuse service or terminate accounts that violate this section.
2. Licence
The developer grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game for your own non-commercial entertainment on devices you own or control. All rights not expressly granted are reserved. You may not copy, modify, reverse-engineer, sell, rent, sublicence, or create derivative works from the Game except as permitted by applicable law.
3. Virtual currency and items
3.1 No real-world value
Stars, skins, wishes, chests, and any other in-game items (collectively, "Virtual Items") have no monetary value. They cannot be redeemed for real money, transferred between accounts, or sold to other players. You do not own Virtual Items; you receive a limited licence to use them inside the Game.
3.2 All sales are final - no refunds for Virtual Items
Once a purchase of Virtual Items (or content unlocked using Virtual Items, including but not limited to skins obtained via the Wish / gacha mechanic) is completed, the transaction is final and non-refundable to the maximum extent permitted by law. This includes, without limitation:
- Stars purchased through the in-game shop;
- Skins, banners, or other cosmetic content unlocked via Wish pulls;
- The "Remove Ads" entitlement, once activated on your account/device.
You acknowledge that Virtual Items are digital content delivered immediately upon purchase and consumed within the Game. By initiating a purchase you expressly request and consent to immediate performance and, where applicable under Article 16(m) of EU Directive 2011/83/EU (Consumer Rights Directive) or equivalent local statutes (e.g. UK Consumer Contracts Regulations), you acknowledge that you will thereby lose your right of withdrawal / cancellation once delivery begins.
Star balances cannot be individually restored
Star balances are stored as a single aggregate value on your device and (when signed in to Google Play Games / Apple Game Center) in your cloud save snapshot. The Game does not track individual purchases against the star balance: once stars from a purchase are credited to your wallet, they are indistinguishable from stars earned through gameplay, rewarded advertising, or any other source. As a result, star balances cannot be partially, selectively, or retroactively restored for any reason, including without limitation:
- your use of the in-game "Delete My Data" affordance;
- app uninstallation, factory reset, or platform-level account deletion;
- cloud-save sync that was interrupted before reaching the cloud (network failure, app force-close, device shutdown, sign-out, or revoked platform permission occurring between purchase and sync);
- local data corruption, file-system errors, or device storage loss;
- any cache, debounce, throttle, scheduling, or timing event that prevented a wallet write from being persisted; or
- any third-party service outage (Google Play, App Store, Play Games, Game Center) that disrupted purchase fulfillment or sync.
The only Virtual Item that survives the events above is the Remove Ads entitlement, because it is a non-consumable purchase that the platform store (Google Play / App Store) remembers on your account indefinitely; it is re-applied automatically on next launch (or on demand via Settings → Restore Purchases).
3.3 Platform refund policies
Any refund must be requested directly from the platform that processed the payment (Apple App Store, Google Play, or another distributor). The developer cannot issue refunds for purchases made through a platform we do not control. Platform refund policies (e.g. Apple's "Report a Problem" or Google Play's refund window) apply at the platform's discretion, not ours.
3.4 Cloud save is best-effort
The Game synchronises your wallet, owned skins, achievement progress, records, and onboarding state to Google Play Games Services (Android) or Apple Game Center (iOS) when you are signed in to the relevant platform service. Cloud save is provided as a convenience and is best-effort, not a guaranteed service. Sync requires:
- that you are signed in to Play Games / Game Center on the device,
- that the device has a working network connection at the time of sync, and
- that the platform's cloud-save infrastructure is available.
Sync may be delayed, deferred, throttled, or skipped due to network conditions, platform rate limits, app lifecycle events (backgrounding, force-quit, OS-initiated process kill), or the Game's internal batching of state changes. The developer makes no warranty that any specific game-state change will reach the cloud within any specific time, or at all, before the next event that may rely on it (uninstall, "Delete My Data", device loss, etc.).
To minimise the risk of progress loss:
- remain signed in to your platform games service;
- allow the Game several seconds to settle after a purchase, gacha pull, or tutorial completion before closing or uninstalling;
- do not perform "Delete My Data" or uninstall immediately after a purchase you wish to preserve across devices.
Losses or apparent rollbacks caused by interrupted, failed, or incomplete cloud sync are not refundable and are subject to the non-restorability provisions of section 3.2.
4. Wish / gacha mechanic - fair-play disclosure
The Game's "Wish" mechanic awards cosmetic skins from a fixed, finite pool. We design it to be transparent and to avoid the worst patterns of randomised loot-box monetisation:
- No duplicates. Every pull draws from skins you do NOT yet own. You can never receive a duplicate of a skin you already own.
- Finite pool. Each banner contains exactly 9 collectible skins (4 common + 2 rare + 1 epic + 1 legendary + 1 mystery). The total number of pulls required to complete a banner is known in advance.
- Free first pull. Your first ever Wish is free.
- Free mystery unlock. Once you own all 8 standard skins on a banner, the 9th (mystery) skin is awarded automatically on your next Wish at no cost.
- Uniform odds. Each Wish draws uniformly at random from your remaining unowned skins on the active banner - the chance of receiving any one unowned skin is exactly 1/N, where N is the number of skins you do not yet own on that banner.
See the Wish Odds page (also displayed in-game under Settings → Wish Odds) for the full odds table per banner state. Drop rates are displayed in the Wish menu before each pull.
5. Acceptable use
You agree not to:
- Cheat, exploit bugs, or use unauthorised third-party software, automation, scripts, or modified clients to gain an advantage in the Game or to obtain Virtual Items outside intended gameplay;
- Reverse-engineer, decompile, or attempt to extract source code or assets from the Game;
- Access another person's account, or share, sell, or trade access to your own account;
- Use the Game for any unlawful, harmful, or fraudulent purpose;
- Attempt to disrupt the Game's services, servers, or other players' enjoyment.
Violating this section may result in suspension or termination of your licence and forfeiture of Virtual Items without refund.
6. Advertising and rewarded ads
The Game may show advertising, including rewarded video ads that grant Virtual Items in exchange for watching. You may purchase the "Remove Ads" entitlement to suppress non-rewarded advertising. Removing ads does not remove rewarded-ad opportunities; those remain available as an optional way to earn additional Virtual Items.
7. Privacy
Your use of the Game is also governed by the Privacy Policy, available in-game under Settings → Privacy. By using the Game you consent to the data handling described there.
8. Changes to these terms
The developer may update these Terms from time to time. When a material change is made, the in-game version number tracked in your preferences will be bumped, and the Game will prompt you to review and accept the updated Terms before continuing to play. Continued use after acceptance constitutes agreement to the updated Terms.
9. Termination
You may stop using the Game at any time by uninstalling it. The developer may suspend or terminate your licence, with or without notice, if you breach these Terms or if continued provision becomes commercially or legally impracticable. Upon termination, sections 3 (Virtual Items), 10 (Disclaimers), 11 (Limitation of Liability), and 13 (Governing Law) survive.
10. Disclaimers
The Game is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted / error-free operation, to the maximum extent permitted by applicable law.
11. Limitation of liability
To the maximum extent permitted by applicable law, the developer's total aggregate liability for any claims arising out of or relating to the Game or these Terms is limited to the greater of (a) the amount you paid to the developer in the 12 months preceding the claim, or (b) USD 50. The developer is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption.
Without limiting the generality of the foregoing, the developer is specifically not liable for any loss, corruption, or non-restorability of Virtual Items, wallet balances, owned skins, progress, achievement state, or any other in-game data arising from:
- cloud-save sync interruptions, delays, failures, or rate limits;
- your decision to sign out of, decline, or not enrol in Google Play Games / Apple Game Center;
- your use of the "Delete My Data" affordance;
- app uninstallation, device reset, or operating-system process kill;
- third-party platform or service outages (Google, Apple, or any advertising / billing / cloud-save infrastructure used by the Game).
Some jurisdictions do not permit certain limitations of liability; in those jurisdictions, this section applies only to the extent permitted.
12. Indemnity
You agree to indemnify and hold the developer harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Game, or your violation of any law or third-party right.
13. Governing law and dispute resolution
These Terms are governed by the laws of the developer's place of residence (to be set per release jurisdiction), without regard to conflict-of-laws principles. The parties first attempt to resolve any dispute informally by contacting the developer at the contact address below. If a dispute cannot be resolved informally within 30 days, it will be brought in the courts of competent jurisdiction at the developer's place of residence, except where mandatory consumer-protection law of your country of residence provides otherwise.
14. Contact
Refund requests should be sent first to the platform that processed your payment (Apple, Google). For questions about these Terms or to request deletion of your account/data, contact: hello@5o6.com.
15. Acknowledgement
By tapping "I AGREE" on the first-launch acceptance screen, or by continuing to use the Game after a Terms update, you confirm that you have read, understood, and agree to be bound by these Terms.
Third-party software and asset attributions are listed separately under Settings → Open-Source Licenses.
